These Terms of Service ("Terms") govern your access to and use of thediscerning.one, including its webpages, public materials, digital features and any services expressly stated to be governed by these Terms (together, the "Site").
The Site is operated by Discerning Solutions (S) Pte Ltd ("Discerning Solutions", "DSN", "we", "us" or "our").
TheDiscerning.One is the public institutional brand of The House of Discernment. DSN identifies the family of governed methods, modules, engines, standards and decision systems developed within the House.
By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
These Terms apply to the Site. A signed proposal, statement of work, order form, licence, Decision Credits arrangement, partner agreement, confidentiality agreement or other written agreement may contain additional or different terms. Where there is a conflict, the signed or expressly applicable agreement governs the relevant commissioned work.
1. The House of Discernment
The House of Discernment is the institutional expression of DSN's Game-First Decision Architecture.
Its governing principle is:

The wrong game, played with confidence.
The architecture may include the DSN:Game-First Engine and specialised DSN modules such as DSN:UCB [Undercurrent Briefings], DSN:CGS [Category Game-Shaper], DSN:Decision Diagnostic, DSN:PRISM, DSN:ALCHEMY and DSN:CLEAR.
Public explanations of these methods are intended to help people understand DSN's point of view and approach. They are not, by themselves, a commissioned application of the controlled method.
2. Public content is not a formal DSN ruling
Material published on the Site may include:
Articles and thought leadership;
Undercurrent Briefings;
Category Game-Shaper commentary;
Category Game Briefs;
Examples and case illustrations;
Explanations of Game-First Decision Architecture;
Research summaries;
Diagnostic questions;
Public tools or learning materials;
Event or podcast content;and
Other commentary.
Unless we expressly state otherwise in a commissioned engagement, public content is informational and
educational.
Public content does not, merely because you have read, downloaded, shared or applied it:
Create a Decision Object for your organisation;
Create a Decision Record;
Constitute a DSN:CGS diagnosis of your organisation;
Establish your organisation's Current Strategic Posture;
Create a PRISM gate state;
Issue a Fund, Cap, Stop, Transform or Evidence Hold ruling;
Grant cultural, commercial, legal or institutional permission;
Approve a campaign, investment, market entry or strategic move; or
Replace the judgment and accountability of the people authorised to make your organisation's decisions.
A public observation may identify a signal. It is not automatically evidence that demand exists, that an
organisation has permission to act, or that an invested move deserves commitment.
3. DSN supports decisions; it does not make your organisation's decision for you
DSN's methods are designed to help accountable leaders examine and govern invested decisions.
We may identify evidence, assumptions, unknowns, contradictions, conditions, risks, options and possible consequences. In a commissioned engagement, an authorised DSN method may produce a formal DSN judgment within its defined scope.
The final organisational decision remains with the authorised human decision-maker or governing body of the organisation concerned.
You remain responsible for:
Deciding whether to act;
Deciding how much to commit;
Obtaining legal, regulatory, financial, tax, accounting, clinical, technical or other specialist advice where required;
Verifying information material to your decision;
Complying with applicable law and regulation; and
Accepting the consequences of your organisation's final choice.
DSN does not guarantee that a decision will succeed.
A well-governed decision can still produce an unfavourable outcome. A poorly governed decision can sometimes produce a favourable outcome through luck. Outcome quality and decision quality are not the same.
4. No professional advice unless expressly appointed
The Site is not a substitute for professional advice.
Unless Discerning Solutions is separately qualified and expressly appointed in writing to provide such services, Site content does not constitute:
Legal advice;
Regulatory advice;
Accounting or audit advice;
Tax advice;
Investment or securities advice;
Medical or clinical advice;
Cybersecurity certification; or
Any other regulated or licensed professional advice.
Where a DSN decision requires specialist expertise, the appropriate qualified authority should be involved.
5. Use of the Site
You may use the Site for lawful personal, professional, research and organisational purposes in accordance with these Terms.
You must not use the Site to:
Break any applicable law or regulation;
Infringe another person's rights;
Misrepresent your identity, authority or relationship with DSN;
Interfere with the Site's operation or security;
Introduce malware, malicious code or harmful automated activity;
Attempt unauthorised access to accounts, systems or controlled materials;
Scrape, extract or reconstruct non-public or controlled DSN materials through automated means;
Bypass technical or contractual access controls;
Use the Site to harass, threaten, defraud or unlawfully discriminate;
Submit information that you have no right to provide; or
Represent an unauthorised or materially altered framework as official DSN practice.
Reasonable indexing by ordinary search engines and lawful quotation or reference to public materials are not prohibited merely because they involve automated systems. Restrictions in these Terms are directed at misuse, unauthorised extraction, circumvention and misrepresentation.
6. Accounts and access credentials
If the Site offers accounts, member areas, client portals or other restricted features, you must:
Provide accurate information;
Keep your credentials secure;
Use access only within the authority granted to you;
Notify us promptly if you suspect unauthorised access; and
Not share restricted access in a way that circumvents licence, subscription, membership or organisational controls.
You are responsible for activity carried out through your account to the extent permitted by law, unless the activity results from a security failure for which we are legally responsible.
We may suspend or restrict access where reasonably necessary to protect security, investigate misuse, comply with law, preserve method integrity or enforce an applicable agreement.
7. Commissioned DSN work
Commissioned DSN work normally requires a defined scope and may be governed by one or more separate documents, including:
A proposal or statement of work;
An order form;
A licence;
A Decision Credits arrangement;
A confidentiality agreement;
A data-processing arrangement;
An authorised-use agreement; or
Another written engagement document.
Those documents determine the actual services commissioned, deliverables, timetable, fees, payment terms, licences, confidentiality obligations and other engagement-specific matters.
Nothing on the public Site obliges DSN to accept an engagement.
DSN may decline, refer, hold or narrow work where the decision is outside DSN's competence, authority, independence requirements or governed scope.
8. Decision Credits
Where Decision Credits are offered, they operate as DSN's commercial work-authorisation and delivery-accountability units.
The governing distinction is:
Decision Credits determine the work DSN is authorised to perform. They do not determine the judgment DSN is
authorised to reach.
Purchasing, holding, allocating or activating Decision Credits does not purchase:
An Open gate;
A favourable CGS posture;
A Fund ruling;
A particular recommendation;
A higher level of decision confidence;
Removal of a material condition;
Suppression of contrary evidence; or
An outcome guarantee.
Decision Credit pricing, validity, expiry, wallet rules, transfers, allocations, refunds, cancellation treatment, promotions, partner arrangements and other commercial details are governed by the then-applicable Decision Credits Operating Standard and/or the applicable written commercial agreement.
If those commercial terms conflict with this Site-level description, the applicable controlled commercial terms govern the commercial matter. They do not change DSN's method judgment.
9. Intellectual property and the DSN method
The Site and the materials made available through it may contain intellectual property owned by, licensed to or otherwise lawfully used by Discerning Solutions and/or its licensors.
This may include:
Names and marks;
Written content;
Diagrams;
Visual systems;
Taxonomies;
Templates;
Controlled terminology;
Method architecture;
Training material;
Software logic;
Databases;
Research compilations; and
Other materials.
The exact legal ownership and protection of a particular asset depends on applicable law, registrations, contracts and ownership records.
Unless expressly stated otherwise, access to the Site gives you a limited right to read and use public Site material for lawful informational purposes. It does not transfer ownership of DSN intellectual property.
In particular:
Access to DSN material is not the same as authority to teach it, practise it, adapt it, license it or represent work
as DSN work.
A person may learn from a public DSN idea without becoming an authorised DSN practitioner.
A client may purchase DSN work without acquiring ownership of the method used to produce it.
Attribution does not by itself create a licence.
10. Permitted quotation and public reference
You may quote reasonable portions of public Site material for commentary, criticism, research, education or ordinary professional reference where permitted by law, provided that you:
Attribute the source truthfully;
Do not imply DSN endorsement;
Do not present an extract as the complete method;
Do not remove material qualifications in a way that changes the meaning; and
Comply with any specific notice attached to the material.
A public-use statement does not grant permission to copy or reproduce controlled tools, practitioner materials, non-public templates or licensed methods beyond the rights expressly granted.
11. No unauthorised DSN representation
You must not, without express written authority:
Claim to be an authorised or accredited DSN practitioner;
Describe your own assessment as an official DSN:CGS diagnosis;
Describe a self-created scorecard as PRISM;
Issue a purported DSN ruling;
Use DSN names or marks in a way that implies partnership, certification, sponsorship or endorsement;
White-label DSN's controlled methods as your own;
License DSN material to another person; or
Remove required attribution from licensed or controlled material.
If you adapt public DSN ideas independently, you must not represent materially changed work as the governed DSN method.
12. User-submitted information
You may provide information through contact forms, account features, questionnaires, research participation, enquiries, commissioned work or other Site functions.
You retain your rights in information you submit.
You give us the limited permissions reasonably necessary to:
Receive and review it;
Respond to your request;
Provide or assess the requested service;
Administer the relationship;
Comply with law;
Protect security; and
Perform other purposes described in our Privacy Policy or an applicable agreement.
You must have the right and authority to submit the information.
If you provide personal data or confidential information about another person or organisation, you are responsible for ensuring that you are authorised to provide it and that any required notices or consents have been given.
13. Confidential information
The Site may provide ways to contact DSN, but a general enquiry does not automatically create a confidential client relationship.
Do not send highly sensitive, privileged, trade-secret or regulated information through a general public form unless the form is specifically intended for that purpose or an appropriate confidentiality arrangement is already in place.
Where DSN accepts confidential information under a signed agreement, that agreement governs confidentiality.

14. AI-enabled features and AI-supported work
The House is AI-enabled and human-governed.
Where the Site or a commissioned service offers an AI-enabled feature, AI may support tasks such as:
Organising information;
Summarising material;
Identifying patterns;
Detecting contradictions;
Monitoring conditions;
Assisting research;
Maintaining records;
Routing workflow; or
Identifying matters for human review.
AI-generated or AI-assisted material may be incomplete, uncertain or incorrect and should be assessed in context.
Within the governed DSN architecture, AI does not independently become the accountable authority for:
Consequence;
Legitimate weighting of interests;
Permission;
Commitment;
Exceptions;
Final PRISM rulings; or
Organisational accountability.
Where an AI-enabled feature has additional terms, those terms also apply.
15. Third-party services and links
The Site may link to, embed or rely on third-party platforms, websites, payment providers, analytics services, hosting providers, research sources, social platforms or other services.
A link does not automatically mean that DSN endorses the third party or accepts responsibility for its content, security, availability or practices.
Your use of a third-party service may be governed by the third party's own terms and privacy policy.
16. Research, external sources and public evidence
DSN may refer to external research, market data, public records, media reporting, company statements and other third-party sources.
We aim to distinguish evidence from interpretation, assumption and uncertainty. However:
Sources can contain errors;
Information can become outdated;
Later events can change the meaning of earlier evidence; and
Reasonable people can interpret the same evidence differently.
You should verify information that is material to a consequential decision.
17. Availability and changes to the Site
We may update, replace, restrict, suspend or discontinue Site content or features.
We do not promise that:
Every feature will always be available;
Site content will always be complete or current;
Every error will be corrected immediately; or
A public version of a method will remain unchanged.
Controlled DSN methods may evolve through formal version control. A public page should not be treated as the authoritative source for the method version governing a commissioned case unless the applicable engagement says so.
18. Disclaimers
To the fullest extent permitted by law, the Site and public content are provided on an "as available" basis.
We do not warrant that public Site content:
Guarantees growth, demand, campaign success or financial performance;
Eliminates uncertainty;
Predicts outcomes with certainty;
Is suitable for every organisation, industry or decision;
Establishes legal or regulatory compliance; or
Justifies an invested decision without further examination.
The House is designed to reduce unjustified confidence, not manufacture certainty.
Nothing in these Terms excludes any warranty, right or remedy that cannot lawfully be excluded.
19. Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
Subject to that rule, Discerning Solutions is not responsible for loss arising solely because a person:
Treated public Site material as a formal commissioned DSN ruling;
Acted without verifying material information;
Ignored a stated qualification or limitation;
Relied on a third-party service or external source outside our control;
Used an unauthorised or materially altered version of a DSN method; or
Used the Site in breach of these Terms.
For commissioned services, any agreed limitations or allocations of liability are governed by the applicable written engagement.
20. Your responsibility for misuse
You are responsible for losses, claims, costs or liabilities arising from your unlawful use of the Site or your knowing misrepresentation of unauthorised work as authorised DSN work, to the extent permitted by applicable law.
This provision does not make you responsible for matters caused by DSN's own breach or wrongdoing.
21. Suspension and termination
We may suspend or terminate access to restricted Site features where reasonably necessary because of:
Security risk;
Suspected fraud;
Unauthorised access;
Material breach of these Terms;
Misuse of controlled material;
Misrepresentation of authority;
Legal or regulatory requirement; or
Termination of the underlying agreement that granted access.
Where practical and appropriate, we may give notice and an opportunity to correct the issue.
Termination of Site access does not erase obligations that by their nature should continue, including intellectual-property restrictions, confidentiality obligations, payment obligations already incurred, disclaimers, liability provisions and dispute provisions.
22. Privacy
Our Privacy Policy explains how we collect, use, disclose, protect, retain and otherwise handle personal data.
By using the Site, you acknowledge that personal data will be handled as described in the Privacy Policy and applicable agreements.
23. Changes to these Terms
We may update these Terms to reflect changes in:
Law or regulation;
The Site;
DSN's services;
Technology;
Security requirements;
Commercial arrangements; or
The controlled architecture.
The effective date at the top of this page shows when this version took effect.
Where a change materially affects an existing paid or licensed arrangement, the applicable signed agreement or controlled commercial terms will determine whether and how the change applies to that arrangement.
Continued use of the Site after updated Terms take effect constitutes acceptance to the extent permitted by law.
24. Governing law and disputes
These Terms are governed by the laws of Singapore, without regard to conflict-of-law principles.
Subject to any different dispute process expressly agreed in writing, the courts of Singapore will have jurisdiction over disputes arising from or relating to these Terms or the Site.
Nothing in this clause prevents either party from seeking urgent interim relief from a court with appropriate jurisdiction where legally available.
25. General terms
Entire Site agreement
These Terms and the Privacy Policy form the general agreement governing use of the Site. They do not replace a signed engagement, licence or commercial agreement for commissioned DSN work.
No waiver
If we do not immediately enforce a provision, that does not mean we waive it.
Severability
If a provision is found unenforceable, the remaining provisions continue to apply to the extent permitted by law.
Assignment
You may not transfer restricted access rights, licences or contractual rights merely by sharing credentials or materials. Any formal assignment is subject to the applicable agreement and law.
No partnership or agency
Using the Site does not by itself create a partnership, joint venture, fiduciary relationship, employment relationship, agency relationship or client engagement between you and Discerning Solutions.
Headings
Headings are for readability and do not limit the meaning of these Terms.
